Houston Reasonable Accommodation Lawyers

The Americans with Disabilities Act, first passed in 1990 and most recently amended in 2008, declared it unlawful for employers to discriminate against their employees or prospective employees on the basis of a physical or mental disability. While the ADA acknowledges that there are some cases where a disability is of a nature or severity that it would indeed render an employee unable to perform the work associated with a job, it insists that a company offer reasonable accommodation to other disabled workers. Failure to do so constitutes a violation punishable by fines and subject to legal action on behalf of the worker who was denied reasonable accommodation.

If an employer has made any adverse decision regarding your employment or potential employment because of a disability with which you are afflicted, contact the Houston reasonable accommodation lawyers of the Ross Law Group at 713-482-6910.

Understanding Reasonable Accommodation

An accommodation is considered reasonable if it would allow an employee to meet the demands of a position and would not impose a hardship upon the business or interfere with the course of normal operations. There are three different kinds of reasonable accommodations outlined by the ADA. They are accommodations to the:

  • Job application process
  • Work environment
  • Structure of benefits and privileges

Some accommodations that employers are frequently asked and required (where possible) to make include:

  • Adapting testing instruments and in-house documentation
  • Schedule adjustments
  • Physical modifications to the workspace or building to allow for accessibility
  • Purchasing special equipment that enables an employee to perform necessary job duties
