Rico's Mexican Grill sued for overtime claims

The Woodlands-based Tex-Mex chain restaurant Rico's Mexican Grill is being forced to vacate multiple locations after being sued by several employees over the failure to pay for hours worked overtime.

Officials with the restaurant chain said the economy has hurt their business over the past several years.  As of earlier this month, 30 people were involved in an overtime claims lawsuit against Rico's.

The lawsuit was filed in July by a former employee and former owner.  The restaurant is accused of continuing to pay the former employee his regular wage of $9.50 an hour for hours worked overtime.  Under the Fair Labor Standards Act, other employees with similar complaints are allowed to join in the suit.
