GulfCoast LTC Partners Inc. sued for not paying overtime

Earlier this month, an overtime claims lawsuit was filed against GulfCoast LTC Partners Inc. in the Marshall Division of the Eastern District of Texas.  Karen Poole filed the lawsuit on behalf of herself and her coworkers who did not receive pay for hours worked overtime.

Poole worked as a business manager at the company from August 2006 to February 9th, 2011, the day she filed the lawsuit.  According to the lawsuit, Poole claims that herself and other employees that should be considered "hourly" workers, were wrongly categorized as "salaried" workers.  Hourly workers are able to receive overtime pay if they work more than 40 hours a week, while salaried workers are not.  The Fair Labor Standards Act determines whether or not an employee should receive an hourly wage or a salary.

Poole is asserting that because herself and some of her co-workers were miscategorized as salaried workers, they were missing out on the pay they deserved for working more than 40 hours a week.
