Can your employer file you during FMLA time?

Individuals may not be fired during their FMLA time. This provision gives employees the security that taking FMLA time will not affect their job status. 

However, once FMLA time ends, employees should stay in contact with their employer about their job status. If the employee is unable to perform normal work functions and the company has not light duty work available, then the company may be able to fire the employee.
