Woman sues daycare claiming wrongful termination

A woman is now suing a daycare for wrongful termination after she claims they fired her for reporting a possible child abuse situation.

According to the lawsuit that was filed on Dec. 12, the Beaumont woman was fired from Kiddie Korner Day Care after she admitted that she reported this case. The woman claims she is the victim of discrimination and wrongful termination. She is currently seeking punitive damages.

Hollister Co. worker fired for wearing hijab

Abercrombie & Fitch Co. is being sued for wrongful termination after a stockroom employee was fired for wearing a hijab.  The lawsuit was filed by a former female employee who says she was told she could wear the traditional Muslim headscarf when she was hired.

The 20-year old woman had been working at Abercrombie's Hollister Co. store in the Hillsdale Mall in San Mateo, California for four months when a district manager and human resources manager for the store asked her not to wear her hijab while working.  The former employee refused to do so and was suspended before being fired.

Abercrombie & Fitch Co. has had two similar lawsuits filed against it by women who argued that the store refused to hire them for wearing hijabs.

Texas City man sues Comcast for wrongful termination

A former Comcast of Houston LLC employee is suing the company alleging wrongful termination.  Texas City resident Daniel Antley worked for Comcast and Timewarner for almost a decade.  Issues began to arise when Antley needed to take time off from work after having back surgery in August 2007.

Doctors told Antley he need to take off work for at least 6 months after his surgery to recover.  However, supervisors at Comcast demanded that Antley return after four months or he would lose his job.  Antley returned to work early but never fully recovered from his surgery.  He later had a second back surgery in June 2009.

In October 2009, supervisors once again demanded Antley return to work or he would be terminated.  Antley returned but was later fired without reason in Decemeber.  He is arguing that he was subjected to disability discrimination, harassment, and retaliation, in addition to the wrongful termination.

Employee terminated after filing workers' comp claim

A South Texas information technology worker recently filed a wrongful termination lawsuit in the Galveston County District Court for her firing after filing a workers' compensation claim.  The worker, Sharon K. Malone, was employed with College of the Mainland and worked in their mathetmatics department's IT department for more than 15 years.

According to court documents, the company suffered a water pipe break in 2001 and continued to have pipe leaks for several years after.  The pipe break and leaks released mold into the work facility and caused Malone to become ill in October 2007.  Malone then filed a workers' compensation claim related to her illness, but the claim was denied, and she was released from her position.

Former ESPN reporter sues for wrongful termination

Former ESPN sportscaster, Ron Franklin, was fired just last month for remarks he made to a fellow reporter in a conversation outside of work.  Franklin reportedly called Jeannine Edwards names like "sweetheart" after she interrupted a conversation he was having in a hotel lobby before the Chic-fil-A Bowl.

In the lawsuit, Franklin argues that he was wrongfully terminated from his position because his firing had nothing to do with an inability or failure to perform the duties of his position.  The suit names the incident between Franklin and Edwards a "contentious exchange".  After the exchange, Franklin was taken off of his next project and suspended.

Franklin had a two-year contract with ABC and ESPN that lasted through March 2012.  The contract contained a "failure to perform clause" that permitted firing if Franklin had frequently come to work inadequately prepared or late.

Soldier sues former employer Vitro for wrongful termination

A soldier and former employee of Vitro America LLC recently filed a wrongful termination lawsuit against the company.  Walter Long claims that when Vitro fired him in 2005 they failed to comply with the U.S. Soldiers and Sailors Employment and Reemployment Act.

Long began working for Vitro in Birmingham, Alabama in March 1992.  In August 2005, Long informed officials at the company that his Army reserve unit was being called to active duty and that he would need to temporarily leave his position.  

In late 2006, Long's unit was deployed to Iraq and in May 2007 Long was injured.  For the next six months, Long recovered at Fort Hood in Texas and says he informed Vitro of his injury and recovery time.  When Long was no longer on active duty and had recovered from his injury, he returned to Vitro America LLC.  Upon his return, Long was notified that he had been terminated from his position.

Mike Leach files wrongful termination lawsuit

Mike Leach, the Texas Tech head football coach who was fired last December two days after mistreating a player with a concussion, has filed a wrongful termination lawsuit against the university.  Initially, the lawsuit was dismissed after a judge ruled that the university was able to claim protection by sovereign immunity.  Leach and his attorneys appealed this verdict and await a second decision.

Immunity occurs when a state entity cannot be sued before the Texas Legislature gives permission or without a waiver for a defendant's poor conduct.  Leach appealed the verdict arguing that Texas Tech does not have immunity based on its conduct after the termination.  The appeals court has no deadline to come to its decision.
