Caldwell County woman wrongfully terminated for whistleblowing

Katrina Harper, a former Caldwell County jailer, filed a federal lawsuit in Austin's U.S. District Court against her former employer.  

In May 2009, Harper says she was working the night shift when she witnessed two of the county jail employees engaging in sexual activities.  Harper immediately went to her supervisor and told them what she had seen.  Harper was sent home early that day and two days later was written up for reporting what her supervisor's believed the be a false incident.  She was later demoted to officer from her position as corporal.  

Just months later, Harper received a letter from her employer asking her to disclose information about her ADD disorder.  After sending in the appropriate documentation, Harper was terminated a day later for supposedly not disclosing her medical history in her employment application.  Harper believes that the County is using her medical disability as an excuse to cover up their discrimination.

Two Texas nurses awarded $750,000 in whistleblower suit

In 2009, two Texas nurses, Anne Mitchell and Vickilyn Galle, sent an anonymous letter to state regulators about their concerns over Dr. Rolando G. Arafiles Jr.'s practices.  The two claimed that the doctor did not maintain proper medical records, used poor medical judgement, and provided poor medical treatment to patients.

Arafiles investigated who sent the letter and charged the women with misuse of information.  Charges against Galle were dropped, and Mitchell was acquitted in February.  Still, the women have been unable to find work since the incident.   

Recently, the women reached a settlement of $750,000 in their suit against the doctor and Winkler County officials for being fired and charged after filing their complaint.

The limits of the Texas Whistleblower Act

Employees who know of unlawful acts by a government employee or agency are afforded certain protections. Under the Texas Whistleblower Act, such public employees are provided a number of legal rights. 
 
However, this act only applies to public employees, not to private employees. Public employees who report such acts may recover injunctive relief, actual damages, and court costs for the case.

The dual purpose of whistleblower procedures

Most companies are required to have procedures for reporting abuse, fraud, or corruption. These procedures are typically known as whistleblower procedures.

These procedures usually serve a dual purpose. On the one hand, they provide a reliable means for the company to learn of fraud from its employees. This is useful because many cases of fraud can only be detected on the employee level. 

On the other hand, these procedures typically proivde a safe way for employees to report abuse. In many cases, employees do not report fraud because they believe that such a report might cost them their jobs. Whistleblower procedures often protect against firings for reporting an alleged fraud.

Former employee files wrongful termination lawsuit against NFLPA

A former employee of the NFL Players Association filed a lawsuit agasint the football labor union Monday. Mary Moran was alledgedly an informant for the Labor Department and gave investigators evidence of illegal labor negotiations between the NFL and the union. 

Moran alledges that she was wrongly terminated for providing this evidence. On the other hand, NFL commissioner Roger Goodell and Houston Texans owner Bob McNair, who also alledgedly participated in the meetings, denied that the two sides took part in illegal meetings.

Whistleblower in Stanford case testifies

Stanford financial adviser Leyla Wydler of Houston received a standing ovation from hundreds of Stanford investors after testifying against her bosses, as part of an $8 billion fraud case against Stanford and other investors. 

Wydler approached her bosses last year with worries about the safety of CDs the company was selling to clients. When Wydler persisted, she was fired from her job. After the firing she took her case to various securities regulators, including the SEC. 

She testified Monday in a Baton Rouge court, where losses by Louisiana investors are estimated at about $1 billion.
