Houston man fired from BAE Systems for being overweight

A Houston man is taking action against his former employer, BAE Systems Inc., after he was fired for weighing 600 pounds.  The man worked at the company's manufacturing plant in Houston from 1994 to October 2009.  Since being terminated, he has lost 200 pounds.

In the lawsuit, the employee says his job required him to sit at a desk and use a computer about 90 percent of the time.  The other 10 percent of his time on the job was spent prepping materials for storage and operating a forklift.  The man asked for a seat belt extension for when he used the forklift, but supervisors denied the accommodation and did not offer any alternatives.

One day, he was told he needed to speak with Human Resources.  H.R. Department officials told the man that he was doing a very good job in his position as a material handler, but that they had to terminate him because he was overweight.  He asked if he could be transferred to another position or department, but officials refused.

Starbucks employee with dwarfism receives $75,000

A former Starbucks employee born with a dwarfism was awarded $75,000 in a settlement between the Equal Employment Commission and Starbucks Coffee Co.  Starbucks admitted to being in violation of Title I of the Americans with Disabilities Act by denying the worker reasonable accommodation. 

The woman was hired as a barista at a Starbucks in El Paso, Texas.  During her orientation, she suggested to supervisors that she could use a stool to make food and drink preparation easier.  

The reasonable accommodation request was denied and she was terminated on the same day the request was made.  The location's manager claimed that using a stool would create a dangerous situation for other employees and customers.
