Man from Denton County files unpaid overtime lawsuit

A man from Denton County has now filed a lawsuit against his former employer after claiming that they owe him money for unpaid overtime after he worked overtime for months and was not paid additionally for it.

According to the lawsuit, which was filed in the Sherman Division of the Eastern District of Texas, the man worked for Viva Railings from April 2010 to November 2011. The man stated that during this time employees were required to work more than 40 hours a week, but were not paid overtime when doing so.

He stated that in those months, he usually worked an average of 56 hours a week. For approximately 39 weeks the man worked for $19.23 an hour and was never paid overtime. The company has now paid overtime partially, but the lawsuit seeks the compensation for unpaid wages as well as emotional distress and liquidated damages.

Loan officer sues bank over overtime pay

A former loan officer at Great Western Financial Services Inc. recently filed suit against the bank in the Eastern District of Texas, Sherman Division on behalf of himself and other loan officers.

According to the complaint, the loan officer worked at Great Western from April 2010 to December 2010.  During his time at the bank, the loan officer claims himself and other officers usually worked more than 40 hours in a week.

In violation of the Fair Labor Standars Act, the bank is accused of only paid the loan officers in commission during hours worked over time.  According to the act, nonexempt employees must be paid time and half for any hours worked in excess of 40 hours per work week.

The suit seeks liquidated damages and unpaid back wages.

Employee owed over $40,000 in overtime pay

A man formerly employed with a railing company in Lewisville recently filed suit against the company and its owners, arguing that he is owed approximately $40,000 in overtime pay.

The plaintiff worked for the defendants as a nonexempt employee for around a year and a half.  In this time, the man says he usually worked between 60 and 70 hours a week.  Being a nonexempt employee, the plaintiff should have received pay equal to time and a half for time spent working over 40 hours a week.

The plaintiff was paid $16,575 in overtime from the defendants, who admit that they owe the former employee money.  The defendants still owe the plaintiff about $40,000 in overtime pay, according to the lawsuit.

Rico's Mexican Grill sued for overtime claims

The Woodlands-based Tex-Mex chain restaurant Rico's Mexican Grill is being forced to vacate multiple locations after being sued by several employees over the failure to pay for hours worked overtime.

Officials with the restaurant chain said the economy has hurt their business over the past several years.  As of earlier this month, 30 people were involved in an overtime claims lawsuit against Rico's.

The lawsuit was filed in July by a former employee and former owner.  The restaurant is accused of continuing to pay the former employee his regular wage of $9.50 an hour for hours worked overtime.  Under the Fair Labor Standards Act, other employees with similar complaints are allowed to join in the suit.
