GulfCoast LTC Partners Inc. sued for not paying overtime

Earlier this month, an overtime claims lawsuit was filed against GulfCoast LTC Partners Inc. in the Marshall Division of the Eastern District of Texas.  Karen Poole filed the lawsuit on behalf of herself and her coworkers who did not receive pay for hours worked overtime.

Poole worked as a business manager at the company from August 2006 to February 9th, 2011, the day she filed the lawsuit.  According to the lawsuit, Poole claims that herself and other employees that should be considered "hourly" workers, were wrongly categorized as "salaried" workers.  Hourly workers are able to receive overtime pay if they work more than 40 hours a week, while salaried workers are not.  The Fair Labor Standards Act determines whether or not an employee should receive an hourly wage or a salary.

Poole is asserting that because herself and some of her co-workers were miscategorized as salaried workers, they were missing out on the pay they deserved for working more than 40 hours a week.

Computer programmer files lawsuit for overtime compensation

An East Texas woman recently filed suit against her former employer, Dell Marketing, for not receiving overtime compensation and violating the Fair Labor Standards Act.  The suit states that Cherie Ross was incorrectly classified by the company and subsequently not afforded overtime pay.

Ross was hired by the company in September 2000 as a computer programmer and analyst.  She argues that despite the position title, she was actually working as a support technician.  This misclassification called Ross an exempt employee when in reality, a support technician position should receive overtime compensation when working over 40 hours a week.

Court documents say that Ross' employer required her to work over 40 hours a week and misclassified her in order to avoid paying her time-and-a-half for overtime hours.  Ross is asking for all unpaid overtime compensation, damages and court costs.

Which businesses are regulated by overtime laws?

According to the Fair Labor Standards Act, businesses that engage in commerce and have more than $500,000 in annual revenues are regulated by federal overtime laws. If a business engages in the production or commerce of goods, then that business is regulated regardless of annual revenues.  
 
This means that these businesses must pay most employees 1.5 times their hourly wage if they work more than 40 hours per week. Some employees, however, do not receive this benefit because they are considered exempt. Exempt employees may include those who are top managers or executives with different compensation contracts.

What happens if you break a non-compete agreement?

Employers may require employees to sign non-compete agreements to prevent them from working for a competitor for a certain period of time. However, since employees often have experience and expertise that would benefit a competitor, employees have the temptation to go work for a competitor, especially if the competitor offers a higher salary. 
 
If former employees break a non-compete agreement, the former employer may file suit, seek an injunction, and collect monetary damages. The former employer may also file a tortious interference claim against the current employer. This claim could result in the current employer facing the same liabilities as the employee.

Which employees are eligible for overtime?

When it comes to overtime, employees typically hold one of two employment statuses. When employees are exempt, they are considered to earn a salary and are exempt from receiving overtime for extra work. 

Employees who are exempt typically include executives and other employees who do administrative work. On the other hand, employees are considered to be nonexempt if they are paid by the hour. As required by federal law, these employees receive overtime in most cases for working more than 40 hours per week.
