Woman files discrimination lawsuit against McDonald's store manager

A former employee at a Lufkin-area McDonald's has now filed a discrimination lawsuit against the store manager because she claims that she was discharged after he violated the Pregnancy Discrimination Act. This act prohibits any sexual harassment at work because a person is pregnant.

According to the lawsuit, the woman began working at McDonald's in 2006 and became pregnant in April 2010. An incident in October 2010 left the woman "constructively discharged." The suit states that the woman was continually the victim of sexual harassment and the store manager used to grab her buttox and talk down to her.

During the woman's last day, the manager yelled at her and when she clocked out that day, she did not return. The woman is seeking punitive damages, compensation as well as back and front payments and court fees.

Houston bartenders file harassment charges with EEOC

by Administrator 13. February 2012 06:46

Two Houston bartenders recently filed sexual harassment and discrimination charges with the U.S. Equal Employment Opportunity Commission. The agency filed suit against the owner of the two bars where the bartenders worked in the U.S. District Court for the Southern District of Texas in January.

The bartenders reported to the EEOC that they had suffered sexual harassment in their workplace from 2006-2008. Sexual harassment involving groping and self-exposure was inflicted on the two women by the restaurants' franchise owner. The women complained about the harassment to the restaurants' corporate human resources department and a store manager, but the harassment continued.

Then, the women took their complaints to the EEOC. After reporting the harassment to the EEOC, the owner retaliated against the bartenders, scheduling one bad hours and firing the other. Harassment continued, and the remaining bartender quit her job.

If you or someone you know quit their job because they were being sexually harassed in the workplace, they have the right to pursue claims of constructive discharge, harassment, and discrimination. 10-year employee sues car dealership over sexual harassment

by Administrator 21. November 2011 09:50

Last month, a 10-year employee at a car dealership in East Texas filed a sexual harassment constructive discharge lawsuit against her former employer.  The woman worked at the car dealership as a salesperson beginning in 2001 and quit her job earlier this year because she was being harassed by her manager.

In the lawsuit, the plaintiff says she was satisfied with her job until 2005 when a new sales manager was hired.  The new manager subjected the woman to sexual insults and degrading sexual comments in front of customers and other employees.

The plaintiff resigned from her position at the dealership in January.  "Her working conditions had become so intolerable as a result of the sexual harassment directed at her that a reasonable person in her position would have felt compelled to resign," states the lawsuit.

Teen alleges sexual harassment at KFC in Sherman

by Administrator 3. August 2011 06:43

A young woman recently filed suit against a Kentucky Fried Chicken fast-food joint in Sherman alleging she was subjected to sexual harassment and gender discrimination by a co-worker.  According to the lawsuit, the company was negligent in failing to take action against the co-worker after the harassment was reported.

The woman worked at the KFC from June 2009 through September 2009 at the age of 17-years old.  She describes the harassment she suffered in her place of employment as both verbal and sexual.  Both the teen and her father went to management about the harassment but no action was taken against the co-worker.

After reporting the harassment and returning to work, the 17-year old saw the harassing co-worker's vehicle outside the restaurant and had no choice but to terminate her employment.  The lawsuit seeks damages for emotional distress, mental anguish, lost wages, and more.

Car dealership sued after constructive discharge

by Administrator 9. May 2011 02:40

A Texas car dealership was recently sued after a former employee was forced to quit her job as the result of management's failure to take action to stop another employee's sexual advances.  Angela Jones, of Beaumont, filed the suit to be compensated for the mental pain and loss of income suffered after the constructive discharge.

Jones began working at the Nederland Chevrolet dealership in December 2009 and sexual advances made towards her by another female employee began in May 2009.  The lawsuit states that another female employee at the dealership groped Jones multiple times.  At least one of the instances was done in the presence of another worker at the dealship.

Management at the car dealship was aware of the sexual harassment but did nothing to stop it.  Jones was forced to leave her position.
