Dallas-based AT&T recently settled an age discrimination lawsuit filed against them by the U.S. Equal Employment Opportunity Commission.  The nationwide lawsuit was filed in August 2009 after a 57-year old retired AT&T employee was turned down for employment by the company.

According to the EEOC, AT&T exercised age discrimination by not rehiring more than 50,000 retired AT&T employees.  AT&T executives noted that they are not admitting to any of the allegations included in the lawsuit by settling.

Still, with the settlement, AT&T is expected to stop any policies that prevent retired employees from being rehired.  In addition, the company is required to update their database to be sure that former employees are in no way prevented from being rehired because of their age.

Texas Roadhouse Restaurants was recently sued for age discrimination in a nationwide lawsuit organized by the Equal Employment Opportunity Commission.  

According to court documents, managers at the restaurant franchise said things like "we think you are a little too old to work here" to applicants and described the ideal applicants for host/hostess positions as "young, hot ones who are 'chipper'."  Specifically, the lawsuit accuses the company of not hiring people over the age of 40-years old for "front-of-the-house" positions like host, bartender, and wait staff.

Only about 1.9 percent of the restaurants' "front-of-the-house" employees are over the age of 40-years old.  Anecdotes from employees and prospective employees, training videos, statistics, and company documents are being used as evidence in the discrimination case.

A 52-year-old Houston woman is filing suit against her former employer after she was fired her for refusing to dye her hair. The woman says she has had grey hair since her 20s and had no interest in dying it.

The plaintiff worked as a branch manager for Capital Title of Texas. When the company was about to move from their location in Katy to one near the Galleria, the 52-year-old's boss asked her to dye her hair and begin wearing fancy jewelry and "younger fancy suits" to fit the new location's image.

Less than a week after refusing to dye her hair, the woman was terminated from her position with the company. Supervisors informed her that her services were no longer necessary, and she was replaced with a younger woman.

A former E.I. DuPont de Nemours and Co. employee has filed suit against the business claiming that he was terminated because of his age and that the company favors younger contract managers.  The 62-year old East Texas man worked for DuPoint as a an offshore contract manufacturing manager in their business sector from September 2002 to September 2009.

In May 2009, the lawsuit states that the contract manager was given a top rating performance review.  Just two week later, officials at the company informed the man that his position was being eliminated after business reviews proved it to be excessive.

However, the former contract manager claims that he was terminated because of his age.  According to the lawsuit, the man was replaced with a far less qualified and much younger foreign employee.  Furthermore, the former employee says that the company practices age discrimination by retaining and promoting only young contract managers.

On February 15th, 60-year old Emma J. Robinson filed suit against Jarvis Christian College in the Eastern District of Texas, Tyler Division for age discrimination.  According to the filing, Robinson worked for the college as executive secretary to the college's president, but was recently demoted from her position.  Her replacement is noted as being less qualified for the position and 15 years younger.

Robinson began working at Jarvis Christian College as a secretary in 1975.  She was promoted a number of times until reaching the highest level secretarial position as executive secretary to the college president.  However, in July 2010, Robinson was informed that she had been demoted to the position of administrative associate for Advanced Services.

In this position, Robinson earns approximately $15,000 less a year than she did in her previous position as executive secretary.  She is seeking both liquidated and statutory damages, lost income, compensation for court costs, attorney fees, and intrestest, and reinstatement to her previously held position.
