Houston man sues former employer for age discrimination

Mark Theodoridis of Houston filed a lawsuit against his former employer, Gay Buick GMC Inc., on August 17th for constant harassment and age discrimination while working for the company as fleet and credit union manager.  

Theodoridis worked for GMC from November 1999 to April 2010.  In 2005, he filed a complaint with the Texas Workforce Commission for feeling that his managers and coworkers treated him differently because he was older.  Theodoridis quit two years later after the issue was not resolved.  In 2009, Gay Buick GMC rehired Theodoridis ensuring him that things would be different.  Theodoridis claims that the discrimination did not end after he resumed his position, but rather was often not invited to luncheons and not paid more commission on internet sales like other employees.  He was later terminated from his position on April 22nd of this year.

Theodoridis is seeking unspecified damages for the embarrassment he suffered and negative effects this will have on his future employment searches.

Two Texas nurses awarded $750,000 in whistleblower suit

In 2009, two Texas nurses, Anne Mitchell and Vickilyn Galle, sent an anonymous letter to state regulators about their concerns over Dr. Rolando G. Arafiles Jr.'s practices.  The two claimed that the doctor did not maintain proper medical records, used poor medical judgement, and provided poor medical treatment to patients.

Arafiles investigated who sent the letter and charged the women with misuse of information.  Charges against Galle were dropped, and Mitchell was acquitted in February.  Still, the women have been unable to find work since the incident.   

Recently, the women reached a settlement of $750,000 in their suit against the doctor and Winkler County officials for being fired and charged after filing their complaint.

East Texas man files suit for wrongful termination

An East Texas man is filing a lawsuit against his former employer claiming that they wrongfully terminated him for collecting workers' compensation.  Field technician Donnie Nash was injured in an on-the-job car accident in May when returning to the Landtel Communications and Rignet's Texas office after being at their Louisiana site.  He claims that when he asked his employer for medical compensation related to the accident, rather than reimburse Nash he questioned the route he took back to Texas.

On June 7th, Nash received noticed that he had been terminated from his position.  He has filed the wrongful termination suit against Landtel Communications and Rignet in the Eastern District of Texas, Marshall Division for failing to pay his rightful overtime compensation and violating the Fair Labor Standards Act and the Texas Labor Code.  Nash is seeking over $500,000 in damages.

Three former assistant managers suing Wal-Mart

Three former Wal-Mart assistant managers are suing the store for wrongful termination.

On December 28th, 2009, Thomas Olson, Martin W. Ellis, and Thomas A. Stewart were working at Wal-Mart when there was a dangerous incident with an armed customer at the South Ridge store in West Virginia.  The customer was caught attempting to use a box knife to cut open electronics boxes and steal the products.  The three assistant managers approached the man and asked him not to do anything to injure anyone in the store.  The man then made a move toward the mangers in what appeared to be an attempt to harm the managers or other Wal-Mart shoppers.  Olson reacted by restraining the man's arms, putting the other employees and customers out of danger.  Authorities later learned that the man had a history of felonies and violent behavior.

Despite their work, Olson and the other mangers were terminated from their positions just weeks later on January 12th. Olson and the other managers argue that his reaction was in line with company policy and that Wal-Mart had no reason to fire them.
