Man Fired for Being Gay

Johnny Smith joined the Creature Production Company to replace a woman who was leaving for Europe. He was hired to run and supervise a wardrobe type department for mechanical dinosaurs and performers.

Smith was harassed because of his sexual orientation several times while he worked there. He was later fired after crew members pushed to replace him with a heterosexual woman who would flirt with them. Smith was then replaced with a heterosexual woman.

Seeing Sexual Harassment

Sexual harassment can be very overt in some situations, but it is generally kept under the radar by the perpetrators. Because of this, it is important to realize when you are being sexually harassed.

A general rule of thumb is to report the harassment to your superiors if you ever feel uncomfortable. This can often fix the problem. If it does not, however, you may need to speak with an attorney.

Supreme Court Ruling Changes Age Discrimination Cases

In a 5-4 decision, the US Supreme Court has changed the burden of proof in age discrimination law suits. Whereas the burden used to fall on the employer, the employee now has to prove discrimination.

This will make age discrimination cases more difficult because employees will be hard pressed to find hard proof of the reasons for their employers' decisions.

Wage Discrimination

University of Phoenix Settles Discrimination Suit

A former employee of the University of Phoenix filed a discrimination lawsuit along with the US Equal Employment Opportunity Commission. The suit alleged that the university told her she would not be considered for a promotion because of an earlier pregnancy discrimination claim she made.

The University of Phoenix has settled the case out of court and will pay $32,500. In the settlement, however, the University of Phoenix admitted to no wrongdoing or liability.

Whistle Blowers

When you find that the company you work for, or an employee of the company, is doing something wrong, it is your duty to report those actions. Unfortunately, there are some cases in which the company will retaliate against you for it.

Often, whistle blower situations involve illegal practices on the part of the company or an employee of the company. When you report this to your superior or a government agency, there should be no action taken against you. If there is, your employer is at fault again.

Discrimination

We often like to tell ourselves that discrimination is a thing of the past and that any person of any race, nationality, creed, color or gender can be treated equally. Unfortunately, this is not so.
