Discrimination, Wrongful Termination Case in Galveston

A wrongful termination suit was filed on April 24 in Galveston County. Two men who were underpaid in relation to their white and hispanic counterparts mentioned it to their superiors several times.

The two men worked for A & L Industrial Services Inc before they were terminated, allegedly because of their race. The men were dismissed on October 5, 2007. They are suing for lost wages, back pay and compensatory damages.

Court Improperly Granted Class Action Status

In 2004, an age discrimination case was brought against 3M Co. The case ended with the court granting class action status to over 4,900 current and former employees.

However, a Minnesota Court of Appeals has said that the court erred in it decision. As such, the case has been sent back down to the Ramsey County District Court. There, the case will undergo further proceedings.

Hooters Settles Discrimination Suit

A Corpus Christi man filed a complaint against Hooters in January for discrimination. He claimed that he was not hired as a waiter because the position was being limited to women.

The suit was settled out of court on April 13. The details of the settlement are confidential. While the man suggested that all Hooters restaurants be named as defendants, the settlement involved only the Corpus Christi franchise.

UTMB Settles Wrongful Termination

In the wake of Hurricane Ike, the University of Texas Medical Branch in Galveston laid off approximately 3000 employees. However, because of the nature of the lay offs, a wrongful termination suit was filed.

The trial was set for October 19 but has since been settled. The school will now keep the 3000 former employees on a rehire list for 36 months after the November 2008 date of termination.

Ruling Puts Firings Under Scrutiny

The wrongful termination suit of two former employees of the Texas Youth Commission after a sexual abuse scandal has been ruled in their favor. This could mean a great deal for more than 100 workers who were also fired.

Another trial is pending to see if the two women will receive damages or get their jobs back. The other employees who were fired or forced to resign may also have suits.

5th Circuit Rules Against 3 Employment Cases

At the beginning of the year, the 5th Circuit had three employment law cases that ruled in favour of the employers. The first was Holloway v. Department of Veterans Affairs. On February 5, the court decided that there was not a hostile environment in a case of blatant racism.

A second case also dealt with racism, but because the employee resigned without trying to work through HR, the court did not acknowledge his claims. A third case involved a woman who was sexually harassed for 90 seconds. However, because it was a one time occurrence that only lasted 90 seconds, it was not considered a hostile work environment.

Sexual Harassment Case Dismissed

The sexual harassment case involving a former paralegal and a Houston attorney has been dismissed. In the case, a former paralegal claimed that she was wrongfully terminated for rejecting sexual advances from attorney Richard Laminack.

The paralegal was terminated on April 14, 2008. Almost a year later, her case was dismissed on April 2. The case was dismissed by Judge Tracy E Christopher in the 295th District Court in Houston.
