Workplace Privacy

The widespread use of information technology in the workplace has made business easier than ever before. However it has also made it easier for employees to use company computers for their own purposes, such as sending personal emails. Many employers have tried to limit this, but they must walk a fine line between enforcing office discipline and respecting workers' rights. At some point, limiting personal use of office technology can become a violation of employees' privacy.

Employee Privacy and the Law

A number of employers require their workers to sign digital privacy agreements. In effect, many of these agreements give employers the ability to screen and filter all communications that take place on company computers and networks. Employees do have some expectation of privacy at work, but in many cases it may be extremely limited. Employers are generally able to conduct searches of their employees' work computers and offices as they see fit.

Even if this is within the rights of the employer, there is still a chance it could become problematic. If an employee uses a company computer for personal email, and the employer is able to view the otherwise private messages, the employer could become aware of information that leads to workplace discrimination. Discrimination is illegal, and its consequences for employees and employers alike can be serious.

Your privacy may be extremely limited in the workplace, but it is not nonexistent. If personal communications lead to harassment or discrimination, you can pursue legal action against your employer. All employees have a right to be free of discrimination in the workplace, no matter what the reason.

If you feel you have been discriminated against at work, whether or not your rights to privacy may have been violated, you are entitled to take action against your employer. By acting now, you can prevent further discrimination, both inside and outside your workplace. The Houston employment lawyers of the Ross Law Group are here to help you.
