USERRA

The Uniformed Services Employment and Reemployment Rights Act, or USERRA, was signed into law in 1994 and designed to protect the jobs held by members of the US military that leave to serve. When an individual is called into active duty, they no longer have to worry that their civilian job will be given to someone else while they are away. Requirements of USERRA

This act is relevant for any men or women that have taken temporary leave of their jobs to serve in the military, regardless of the branch or nature of one’s military employment. Upon returning from deployment, employers must offer these individuals:

• The same position
• The same seniority
• The same pay
• The same status

There is a five year window in which individuals that have moved away from their homes and work to serve the country are eligible for USERRA. An employee returning from active duty should be offered the same position and any necessary training they may need to begin work again.
