This should come as no surprise, given how recently the struggles to attain these rights were carried out in full view of the public. But unfortunately many employees or jobseekers have little awareness of the law and their rights beyond these sweeping, landmark pieces of legislation. Payday Requirements
Despite the fact that most employees go to work for the sole purpose of attaining the wages that they will earn, many do not understand how the law governs the distribution of their pay. Exempt employees (typically salaried workers who do not qualify for overtime pay) must be paid at least once per month, according to Texas law. All other employees must be paid at least twice per month, with the following additional stipulations:
- Paydays must be specified upon hiring
- When payday is semi-monthly (twice per month), the division of the month must be as nearly equal as possible
- If an employee is not paid at the appropriate time, the employer must pay the employee on any business day thereafter upon request
