Restrictions on FMLA
Employees are eligible to receive FMLA benefits as long as they meet the following criteria:
- Work for a business that employs 50 or more people. The 50-employee rule does not apply to federal, state, and local government employers, including public education employers.
- Must have worked for the employer for at least 12 non-consecutive months.
Benefits of FMLA
Employees who qualify for FMLA benefits receive unpaid leave for 60 days per year and a guarantee that their job will be protected for the following reasons:
- To care for a new child, including adopted children.
- To care for a seriously-ill spouse, child, or parent.
- To recover from their own serious illnesses.
- To care for a seriously injured service member.
